काठमाडाैँ। नेपाली कांग्रेसका महामन्त्री गगन थापाले सरकारले कुनै पनि तहकाे सरकारले स्वेच्छाचारी ढङ्गबाट बिदा दिन नपाउने गरी ऐन बनाउनुपर्ने बताउनुभएकाे छ । सरकारले जनयुद्ध दिवसका नाममा आज साेमवार सार्वजनिक बिदा दिएकाे भन्दै चाैतर्फी विराेध भइरहेका बेला महामन्त्री थापाले विज्ञप्ति नै निकालेर स्वेच्छाचारी ढङ्गबाट बिदा दिन नपाउने गरी ऐन बनाउनुपर्ने बताउनुभएकाे हाे ।
महामन्त्री थापाले पछिल्ला दिनमा कार्यकारीको तजबिजमा सार्वजनिक बिदा दिने क्रम सीमाहीन भएको बताउनुभएकाे छ । उहाँले कहिले लहडमा, कहिले भावावेगमा, कहिले सत्ता जोडघटाउमा, कहिले कसैलाई चित्त बुझाउन त कहिले आफ्नो राजनीतिक स्वार्थका लागि बिदा दिइएकाे भन्दै असन्तुष्टि जनाउनुभएकाे हाे । ‘झन् प्रदेश र पालिकामा त पार्टीका कार्यक्रम र पारिवारिक विषयमा समेत सजिलै बिदा घोषणा गरेका उदाहरण छन् । यो नितान्त कार्यकारीको स्वेच्छाचारी मनोविज्ञानको उपज हो । सार्वजनिक बिदाका नाममा यो अराजकता अति भयो !’, उहाँले विज्ञप्तिमा भन्नुभएकाे छ ।
महामन्त्री थापाले कार्यकारीको यस्तो स्वेच्छाचारितालाई नियमन गर्न उसैलाई जिम्मा दिनुको के अर्थ ? भन्दै प्रश्न गर्नुभएकाे छ । कार्यकारी स्वेच्छाचारितालाई रोक्ने व्यवस्थापिकाले हाे भन्दै उहाँले याे विषयमा छुट्टै कानुन बनाएर नियमन र व्यवस्थित गर्दा मात्र यो रोक्न सकिने बताउनुभयाे । ‘न्युजिल्यान्ड, जापान लगायत विश्वका थुप्रै देशहरूमा सार्वजनिक बिदासम्बन्धी कानुन छ, त्यसैका आधारमा बिदा तय गरिन्छ । नेपालमा पनि कानुन बनाएर नियमन नगर्ने हो भने यस्तो स्वेच्छाचारिता झन् बढ्दै जाने निश्चित छ’, उहाँले भन्नुभएकाे छ ।

General Minister Thapa said that a law should be made so that public holidays cannot be given arbitrarily by taking out a notification.
General Minister Thapa has said that the process of giving public holidays at the discretion of the executive is limitless in recent days. He has expressed his dissatisfaction saying that leave was given sometimes in a rush, sometimes in a hurry, sometimes in a power grab, sometimes to please someone and sometimes for his own political interests. There are examples of declaring holidays easily in many states and municipalities even for party programs and family matters. This is entirely a product of the executive’s arbitrary psychology. In the name of public holidays, this chaos has become too much!’, he said in the statement.
What is the meaning of Mahamantri Thapa entrusting him to regulate such arbitrariness of the executive? He asked the question. Saying that the legislature should prevent executive arbitrariness, he said that it can be stopped only when a separate law is made and regulated on this subject. Many countries in the world, including New Zealand and Japan, have public holiday laws, and holidays are decided based on that. If we do not regulate by making laws in Nepal, such arbitrariness is sure to increase”, he said.
